Fair Assessment & Accessibility

Fair access to learning, consistent assessment and reasonable adjustments for learners who need support.

1. Purpose

This policy ensures that Upstart Bar provides fair access to learning, applies assessment requirements consistently and makes reasonable adjustments for learners who need support, without lowering the essential learning standard or the validity of an assessment.

The policy combines Upstart Bar's expectations for equal treatment, disability and accessibility support and fair assessment so that learners and assessors have one clear operating standard.

2. Scope

This policy applies to all Upstart Bar training programs, workshops, assessments, quizzes, practical exercises and learning-support activities, whether delivered face-to-face, online or in hybrid form. It applies to employees, trainers, contractors, assessors, support trainers and relevant delivery partners.

3. Equal treatment principles

  • Learners are treated with dignity, respect and consistency.
  • Access to training and assessment is not restricted on the basis of a characteristic protected by applicable law, client policy or Upstart Bar's equal-treatment commitments.
  • Marketing, examples, activities and facilitation should be inclusive and avoid unnecessary stereotypes or discriminatory treatment.
  • A reasonable adjustment should remove an avoidable barrier where possible, but should not change the essential learning outcome or create an unfair advantage.
  • Support needs are handled discreetly and only shared with people who need the information to arrange support.

4. Identifying support and accessibility needs

Where appropriate, pre-training alignment asks the client and learners about accessibility, dietary and learning-support requirements. Learners may also raise a need directly with the trainer or at info@upstartbar.com. Upstart Bar does not require a learner to disclose a diagnosis where the practical support need can be understood without it.

For client-sponsored programs, Upstart Bar may work with the client's HR, learning, accessibility or venue team to put suitable arrangements in place.

5. Examples of reasonable adjustments

Adjustments are considered case by case, taking account of the learner's need, the nature of the activity, the venue and the essential learning outcomes. Examples may include:

  • Accessible digital materials and the ability to view slides on the learner's own device.
  • Light and dark display modes and larger display or magnification options where available.
  • Seating and room-layout adjustments, including positioning for visibility, mobility or reduced distraction.
  • Additional or differently timed breaks.
  • Additional explanation or one-to-one assistance from a support trainer.
  • Additional time for a quiz or assessment where this does not invalidate the learning objective.
  • Alternative response formats, such as typed rather than handwritten responses, where suitable.
  • Coordination with the client or venue for captions, hearing assistance, accessible access routes or other facility-based support where available.

If a requested adjustment cannot reasonably be provided in the proposed venue or delivery format, Upstart Bar will discuss practical alternatives with the learner and the commissioning client.

6. Fair assessment requirements

  • Assessment criteria should be linked to the stated learning outcomes and explained clearly enough for learners to understand what is being assessed.
  • Equivalent learners should be assessed against consistent criteria. Personal preference, background or irrelevant characteristics must not influence the result.
  • Approved adjustments should not result in a learner being penalized merely because the adjustment was used.
  • Where automated tools or quizzes support assessment, the trainer remains accountable for resolving material errors, ambiguous questions or disputed outcomes.
  • A learner may ask for clarification of an assessment result and may appeal a decision under the Complaints, Appeals, Learner Satisfaction, Cancellation & Refund Policy.
  • Where a learning objective can be demonstrated in more than one valid way, an alternative assessment method may be considered if it preserves the standard being measured.

7. AI-supported assessment, fairness and reliability

The general fair-assessment requirements in this policy are supplemented by Upstart Bar's AI governance controls whenever AI contributes to content, feedback, assessment, examples or learner support. Those controls require review for stereotypes, exclusion, cultural appropriateness, accessibility and unfair outcomes; human review before AI-generated feedback, assessment, coaching or recommendations are used for a material learner decision; and human subject-matter verification of materially AI-assisted learner-facing content.

A learner may challenge or appeal an AI-supported assessment or feedback outcome through the same human complaints and appeals route as any other assessment concern.

8. Inclusive learning design and delivery

Upstart Bar does not rely on fixed learning-style labels. Instead, programs use varied methods such as concise visual explanation, spoken facilitation, demonstrations, individual reflection, polls and quizzes, practical exercises, small-group discussion and applied problem solving. This is intended to create multiple routes for participation without making assumptions about a learner's identity or ability.

As a delivery standard, trainers aim to break up extended instruction with questions, discussion, demonstration or application activity rather than relying on long lecture-only segments.

9. Roles and responsibilities

  • Managing Partner and policy owner: ensure an organization-wide standard for fair assessment and equal treatment.
  • Partner, People or designated accessibility lead: supports complex adjustment, people or accessibility questions and helps coordinate appropriate responses.
  • Trainer lead and Course Owner: ensure course design, assessment and trainer briefing reflect this policy.
  • Trainers and support trainers: apply criteria consistently, respond respectfully to learner needs and escalate issues that cannot be resolved during delivery.
  • Learners: are encouraged to raise support needs as early as possible so reasonable arrangements can be made.

10. Confidentiality and records

Accessibility and support information is treated as confidential personal information and handled in accordance with the Data Protection & Privacy Policy. Only the minimum information needed to arrange support should be recorded or shared.

11. Concerns and appeals

A learner who believes they have been treated unfairly, discriminated against, denied a reasonable adjustment or assessed inconsistently may raise the concern with the trainer or through info@upstartbar.com. Concerns and appeals are handled under the Complaints, Appeals, Learner Satisfaction, Cancellation & Refund Policy, with an independent partner or reviewer used where a conflict of interest exists.

12. Review

This policy is reviewed annually, or earlier if there is a material legal, operational, contractual or delivery change. Feedback, assessment issues, accessibility requests and repeated learner concerns may trigger an earlier review of the relevant course, assessment or delivery process.
